Governor's Consent in Lagos: What Every Buyer Should Know

Many buyers focus on the purchase price and overlook the step that makes their ownership fully secure: obtaining Governor's Consent. It pairs closely with the Certificate of Occupancy, and understanding it protects your investment.

What Governor's Consent is

Under the Land Use Act, land in each state is held in trust by the Governor. When a property that already has a Certificate of Occupancy is sold, the law requires the Governor's Consent to that transfer. Without it, the transaction is not fully recognised.

Why it matters

Consent perfects your title. It means the state formally recognises you as the new holder, which protects you against future disputes, makes it far easier to sell or use the property as security, and gives you clean, bankable ownership.

When you need it

You need Governor's Consent whenever you buy a property that already carries a Certificate of Occupancy. For land held under other arrangements, your solicitor will advise on the correct route to perfection.

What it costs and how long it takes

Consent fees, together with stamp duty and registration, are calculated on the property value and can add a meaningful percentage to your costs, so budget for them from the start. Timelines vary, so begin the process early rather than treating it as an afterthought.

How to obtain it

Your solicitor prepares the deed of assignment and applies to the relevant state office, submitting the title documents, survey and required fees. Once granted, the transfer is stamped and registered, and your ownership is complete.

Treat perfection as part of the purchase, not an optional extra. At MiliaRealty we set out the full cost and process before you commit, so there are no surprises on the road to clean ownership.
